TERMS AND CONDITIONS

  1. Promoter

This promotion is conducted by Burnt Clothing Co., ABN 92 247 171 182, trading as Burnt Clothing Co. of PO BOX 4115, Langwarrin PO, Langwarrin, Victoria, Australia 3910 (“Burnt”, “we”, “us” or “our”).

  1. Promotion name

The promotion is the Burnt Clothing Co. September 2026 R U OK? Fundraising Promotion (“Promotion”).

  1. Promotion period

The Promotion begins at 7:00pm Australian Eastern Standard Time on Monday, 31 August 2026, when private early access opens for Lucky #17 members.

The Promotion ends at 11:59pm Australian Eastern Standard Time on Wednesday, 30 September 2026.

Orders placed outside this period are not included in the Promotion.

Public access to the eligible products begins on Tuesday, 1 September 2026.

  1. Eligible products

The following limited-edition yellow-print products are included in the Promotion:

• limited-edition undiagnosed. tee
• limited-edition undiagnosed. hoodie
• limited-edition overstimulated. tee
• limited-edition overstimulated. hoodie

Together, these are referred to as the “Eligible Products”.

Standard versions, other colourways, other Burnt products, gift cards, shipping charges and any separately purchased products are not Eligible Products.

  1. Eligible purchases

An “Eligible Purchase” is an order for one or more Eligible Products that:

a. is placed through burntclothingco.com.au during the Promotion Period;
b. is successfully paid for and accepted by Burnt; and
c. has not been cancelled, reversed, charged back or fully refunded before Burnt calculates and remits the final donation.

The donation is calculated per Eligible Product, not per order. For example, an accepted order containing two Eligible Products will generate a total donation of AUD $10.

The use of a valid discount code, including an eligible Lucky #17 discount, does not reduce the AUD $5 donation attributed to an Eligible Product.

Using a gift card to pay for an Eligible Product does not prevent that product from qualifying. Purchasing a gift card does not itself qualify.

A replacement or size exchange does not generate an additional donation unless an additional Eligible Product is separately purchased and paid for.

  1. Donation amount

Burnt will donate AUD $5 to R U OK? Limited for every Eligible Product included in an Eligible Purchase.

The donation is made by Burnt from its own funds. Customers are not charged an additional donation at checkout.

No administration fee, payment-processing fee or other deduction will be taken from the stated AUD $5 donation.

There is no minimum purchase requirement and no cap on the total donation generated by the Promotion.

  1. Cancellations, returns and refunds

Orders cancelled or fully refunded before the final donation is calculated will not be treated as completed Eligible Purchases.

Once the final donation has been calculated and remitted, a subsequent return, exchange or refund will not reduce the donation already made to R U OK?

Nothing in these Terms and Conditions limits or excludes any rights or remedies available under the Australian Consumer Law, including rights relating to faulty, unsafe, damaged or incorrectly described products.

Burnt’s standard returns and refund policy continues to apply alongside these Terms and Conditions. If there is any inconsistency, mandatory rights under the Australian Consumer Law prevail.

  1. Payment of the donation

Burnt will calculate the final donation after the Promotion closes and will remit the amount to R U OK? Limited within 14 days after the end of the Promotion.

Burnt will retain reasonable records supporting:

• the number of Eligible Products sold;
• cancelled or refunded orders excluded from the calculation;
• the total donation calculated; and
• confirmation that the donation was remitted.

Burnt will publish the final donation amount through its website or owned social media channels after payment has been made and confirmed.

  1. Relationship with R U OK?

This fundraising activity and Burnt’s permitted use of the “Proudly Supporting R U OK?” brand element have been approved by R U OK?

Burnt is supporting R U OK? through this approved fundraising activity. Burnt is not a partner, major partner, sponsor, representative or agent of R U OK?

R U OK? does not manufacture, sell, supply or warrant the Eligible Products and is not responsible for order fulfilment, delivery, exchanges, refunds or customer service.

The Promotion does not imply that R U OK? endorses Burnt, the Eligible Products or any other Burnt product.

All R U OK? names, trade marks and brand elements remain the property of R U OK? Limited. They may only be used by Burnt in the form and manner approved by R U OK? and for the duration of the approved activity.

  1. No tax-deductible donation by the customer

Customers are purchasing goods from Burnt and are not making a direct donation to R U OK?

Purchases made through the Promotion are not represented as tax-deductible donations. Burnt will not issue a donation receipt to customers, and R U OK? will not issue customers a donation receipt for purchasing an Eligible Product.

Customers should obtain independent taxation advice if required.

  1. Prices and ordering

All prices displayed by Burnt are in Australian dollars and include GST where applicable.

Shipping charges are additional unless the order qualifies for a Burnt free-shipping offer.

The AUD $5 donation does not increase the advertised price of an Eligible Product.

Orders remain subject to Burnt’s normal website terms, payment requirements, shipping policy and product availability.

Burnt may decline or cancel an order where it reasonably believes that the order is fraudulent, unauthorised, affected by a payment error or placed for unlawful purposes. Any cancellation will be handled consistently with the Australian Consumer Law.

  1. Availability

Eligible Products are produced in limited-edition designs and may become unavailable in particular garments, colours or sizes.

Nothing in these Terms guarantees that every Eligible Product or size will remain available throughout the entire Promotion Period.

Burnt will not knowingly advertise an Eligible Product as available where it cannot reasonably supply that product.

  1. No competition or prize

This Promotion is a fundraising sales promotion only.

It is not a game of chance, trade promotion lottery, raffle or competition. No entry, draw, winner or prize is involved.

  1. Privacy

Personal information collected when a customer places an order is handled in accordance with Burnt’s Privacy Policy and applicable privacy laws.

Burnt will not provide customer names, contact information or order details to R U OK? solely because a customer purchased an Eligible Product.

Burnt may provide R U OK? with aggregated sales figures, donation calculations and remittance information for verification and reporting purposes.

  1. Changes or early termination

Burnt may correct an obvious error or make a change to the Promotion where reasonably necessary because of a legal, regulatory, technical or operational issue beyond Burnt’s reasonable control.

Any material change will be communicated through burntclothingco.com.au or Burnt’s owned social media channels.

No change will retrospectively reduce the AUD $5 donation already generated by an Eligible Purchase.

If the Promotion must end early, Burnt will still remit all donations properly generated by Eligible Purchases accepted before the revised closing time.

  1. Complaints and enquiries

Burnt will review and respond to complaints within a reasonable period.

The Promotion and the Eligible Products are intended to encourage meaningful conversations. They are not mental health, medical or crisis-support services.

  1. Governing law

These Terms and Conditions are governed by the laws of Victoria, Australia.

Nothing in these Terms excludes any mandatory law or consumer right that applies in the customer’s State, Territory or country of residence.

  1. Acceptance

By purchasing an Eligible Product during the Promotion Period, a customer acknowledges that they have been given access to these Terms and Conditions.

Participation in the Promotion does not require the customer to make any separate donation or payment beyond the purchase price and any applicable shipping charges.
